Most states have had laws on the books for years that require a man and a woman to be the two parties applying for a marriage license.
Recently Christians have organized to move this "opposite marriage" requirement into the state constitutions of as many states as possible because they wanted to be sure gay marriage could never be legal. After all, if 2 men can get married then heterosexual Christians would suffer no harm whatsoever as a result.
Here in California the law did require that a marriage be between a man and a woman. In May 2008 the California Supreme Court ruled that this opposite gender requirement violated the rights of gay couples to equal justice under the law, because it did.
From June 2008 until November 2008 it was legal for same sex couples to marry in California, my husband and I took advantage of this and were married in June 2008.
A large number of Jeebus-brand bigots who were terribly afraid of equal justice under the law conspired to raise tens of millions of dollars and used this money to buy TV, radio, print and web advertisements telling lies about gay people and provoking fear in the voting public. Thousands of Mor[m]ons in Utah contributed millions of dollars to overturn equal justice under the law for gay couples in California, thus they became "
Out of State Agitators".
On November 8, 2008 a majority of California voters supported the idea of putting ridiculous ancient Jeebus-brand bigotry into the state Constitution.
In May of 2009 the California Supreme Court ruled that putting bigotry in the California Constitution did not violate the California Constitution, so Jeebus won that round. However the court also ruled that those fags and dykes who were married during the window of opportunity were still married, and that the Baby Jeebus could roll that up, put it in His pipe, and smoke it.
So I'm still a married fag and there is nothing any mother fucking Christian bigot assholes can do about it.
Not that I mind people who believe utterly preposterous ancient superstitions conspiring with each other to tell malicious lies about me in order to deny my civil rights! Oh. Wait. I guess I do mind.
A lawsuit was recently filed in US Federal Court claiming that by allowing existing fag marriages to stand but denying new fag marriages the un-married fag couples who wish to marry are being denied equal justice under the law. Depending on how this case proceeds through the courts it is conceivable it could end up in the US Supreme Court, and if Justice Scalia ( a leading provider of homophobic hatred and Jeebus-brand intolerance) dies in time gay marriage could be made legal in all 50 states as an end result of Proposition H8.
