Why isn't this issue being settled at the federal level? America should follow Canada's example and do so.

The Obama administration has already said it would no longer defend the constitutionality of the Defense of Marriage Act, a 1996 law banning federal recognition of gay marriages. Is it because there is not enough support from the American people? I read a couple news articles that say that American support for gay marriage is rising each year. Right now it is like 50/50 or more in favor of it.

Do you think America will legalize gay marriage at the federal level in the near future?

Despite a court having ruled that DOMA (Defense of Bigotry Act) is unconstitutional and despite Obama saying the gummint will not defend Jeebus-brand bigotry it still remains a fact that DH and I will have to hire a tax professional again this year because we can not file a joint return but we each must declare a portion of each other's income because California is a community property state.

It would seem to me that by setting up special rules for the gay married couples to penalize us on taxes is a defacto recognition of our marriage. I wonder why Jeebus has not flooded Washington DC now that the US Government has given married gay couples Special Rights to pay higher taxes.

Marriage laws have always been a state matter, although the Constitution makes it clear that all states are required to recognize a marriage performed in any state. Of course the Constitution does not count when we are oppressing a permanent minority.

They will rule that California must immediately cease and desist persecuting its own citizens based on their sexual orientation. Gay marriage will once again be legal in California.

I just hope that the mother fucking, son of a bitch, malicious bastard, hate mongering Jesus industry pushes their mother fucking luck and appeals to the SCOTUS. Go ahead, Jeebustards, make my day.

Thank you for explaining it to me Ungodly. While I know same sex marriage has been and continues to be a hot issue, I am not up on all the talking points of the debate. I just want them to legalize it. The sooner the better.

Of course my speculation that a case before SCOTUS will overturn anti-gay measures in all states is based on an assumption that the issue the court is considering would have broad, national relevance. It often happens that SCOTUS rulings apply only to a US federal district, or a set of cases based on some other limiting criteria set by the court. So, for example, Proposition H8 could make it to a SCOTUS hearing and SCOTUS might rule in such a way that gay marriage resumes being legal only in California.

I doubt the court would waste its time on obvious red herrings like whether now retired Judge Walker should have recused himself because he is a homo. The Jesus industry does not want to argue on the merits of their bigotry, they prefer to kneecap Judge Walker and/or his findings using any specious, whining, Christian martyrdom claims they can invent. Having read the original decision by Judge Walker I have to say it looked well done.

In the near future the 9th district appeals court will be ruling on Prop H8. I'm expecting that the Baby Jesus will be sobbing for hours.

I skimmed through the .pdf document. First I learned just what Proposition 8 was because I was woefully ignorant of it. I read the proponents defense of Prop 8, which was very weak. Then I skimmed through the Judges ruling and read the conclusion. I think the Judge did a great job on the ruling. His ruling makes perfect sense to me. I don't see how it can be overturned. The arguments seem pretty ironclad.

I think it is just a matter of time before gay marriage is accepted in all 50 states. Acceptance of it is growing in leaps and bounds each year. Just a matter of time.
